This Real Estate Commission Agreement, A.K.A. The Finder’s Fee Agreement (the “Agreement”) is made and entered into as by and between:
A List Realty Group, a California Real Estate Team (“Broker”), and
[Buyer (Client)] (“Buyer”).
RECITALS
WHEREAS, Broker has undertaken to identify potential real estate properties for Buyer;
WHEREAS, Buyer may purchase a property identified by Broker either through Broker or through another real estate agent or broker;
WHEREAS, Broker wishes to ensure compensation for its efforts in locating the property regardless of the agent through whom Buyer ultimately completes the purchase;
NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, the parties agree as follows:
- Identification of Properties Broker agrees to use reasonable efforts to identify and provide Buyer with information about real estate properties that may meet Buyer’s criteria.
- Commission Obligation Buyer acknowledges and agrees that Broker is entitled to a commission if Buyer purchases any property that was identified or shown to Buyer by Broker. This includes situations where:
- The property was shown to Buyer by Broker or listed by Broker within the term of this Agreement.
- Buyer completes the purchase of the property through another agent or broker.
- 2% of the total purchase price of the property, unless stated otherwise.
- Payment Terms The commission shall be earned and payable upon the closing of the sale of the property and shall be disbursed from the escrow or closing agent handling the transaction. Buyer agrees to ensure that the commission is paid to Broker regardless of the agent or broker handling the transaction.
- Term and Termination This Agreement shall commence on the date first written above and shall continue until terminated by either party with thirty (30) days written notice. Notwithstanding termination, Buyer remains obligated to pay the commission as specified in this Agreement for any property identified by Broker that Buyer purchases within six (6) months following the termination of this Agreement.
- Confidentiality Broker agrees to maintain the confidentiality of all information provided by Buyer, except as required to perform Broker’s duties or as otherwise permitted by law.
- Dispute Resolution Any disputes arising from or related to this Agreement shall be resolved through mediation, and if necessary, legally binding arbitration in accordance with the rules of the American Arbitration Association.
- Miscellaneous
- This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral.
- Any modifications to this Agreement must be made in writing and signed by both parties.
- This Agreement shall be governed by and construed in accordance with the laws of the State of California.
